1. Agreement

By accessing 44degrees.ai or using our online tools, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the site or tools.

These Terms of Use are between you and 44Degrees Limited (company number 5842894, New Zealand). If you use the site for a company, you confirm you are authorised to bind that company.

These Terms of Use cover your use of our website and self-serve online tools only. Paid professional services (strategy, design, development, growth marketing, and similar engagements) are governed by a separate Services Agreement and Statement of Work. If there is a conflict for those services, the Services Agreement prevails.

2. What we provide

The website provides marketing information about our services and may include free or paid online tools such as:

• •Free AI visibility checks for apps and related products
• •Paid AI visibility audits and reports
• •Calculators, assessments, waitlists, and similar tools
• •Lead forms and call booking

Website content is general information. It is not legal, financial, tax, or investment advice.

While we use reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law, we do not warrant the accuracy, completeness or suitability of any website content. Website content may be subject to change without notice and we do not undertake to keep the website up to date. We do not warrant that access to the website will be uninterrupted, error-free, or free from viruses.

We may, at any time and without notice, discontinue the site or any tool (in whole or in part), or exclude any person from using the site or tools.

3. Online tools and AI reports

Our AI visibility tools query third-party AI assistants and search surfaces, then summarise what we find. Outputs are estimates based on prompts, model behaviour, and public responses at a point in time. We make no guarantee that AI outputs are free from errors or omissions.

• •Results can be incomplete, outdated, or wrong. AI systems change without notice.
• •Scores and reports are for information only. Do not rely on them as the sole basis for commercial decisions.
• •You remain responsible for reviewing and validating AI outputs before relying on them in decisions, deployments, or user-facing work.
• •We do not guarantee rankings, mentions, traffic, revenue, or any particular business outcome.
• •We do not use your tool inputs to train or improve general-purpose AI models that we offer to other clients.
• •Free tools may be rate-limited, changed, or withdrawn at any time.

Paid audits are delivered after successful payment through Stripe (unless we waive fees). Fees are generally non-refundable once a run has started, except where required by New Zealand consumer law or where we fail to deliver the report for reasons within our control.

4. Your inputs and acceptable use

You confirm that information you submit is accurate to the best of your knowledge and that you have the right to provide it. Do not submit unlawful, confidential third-party, or sensitive personal information about others without authority.

You must not:

• •Scrape, overload, or reverse engineer the tools
• •Bypass rate limits, payment, or access controls
• •Use the tools to build a competing automated service
• •Misrepresent results as certified rankings or official store metrics
• •Use the site for unlawful, harmful, or abusive purposes
• •Facilitate or assist a third party to do any of the above

5. Intellectual property

The website design, branding, and our original content belong to 44Degrees or its licensors. Your use of, and access to, the site and its content does not grant or transfer to you any rights, title or interest in our intellectual property. Unless otherwise permitted in these Terms of Use, you must not copy, reproduce, retransmit, distribute, display, publish, or circulate any part of our website design, branding, or original content, or cause it to be framed or embedded in another website or platform, or create derivative works from it, without our prior written consent.

You keep ownership of the inputs you provide (such as your app name and URLs).

We grant you a limited licence to use generated reports for your internal business purposes. You may not resell our reports as a standalone product without our written consent.

6. Third-party services

The site uses third-party services (for example AI providers, Stripe, Cal.com, analytics, and Meta). Their terms and privacy policies also apply to their processing. We are not responsible for third-party services, including outages or changes to third-party platforms that affect tool output.

For AI visibility tools, third-party AI providers receive product and query context (such as app name, category, market, and competitors), not your email. Contact details are handled by our storage, email, booking, and payment providers as described in our Privacy Policy. Analytics and advertising tools (including Google Analytics and, when configured, the Meta Pixel) may collect online identifiers.

7. Disclaimer and liability

To the maximum extent permitted by New Zealand law, the site and tools are provided "as is" and "as available" without warranties of uninterrupted access, fitness for a particular purpose, or non-infringement.

Nothing in these Terms of Use exclude rights you cannot contract out of under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 (where those Acts apply). If you use the site for business purposes, you agree that those consumer guarantees are excluded to the extent permitted.

To the maximum extent permitted by law, 44Degrees' total liability arising out of or in connection with the site or tools is limited to the fees you paid us for the specific paid tool in the 12 months before the claim, or NZD 100 if you used only free tools. We are not liable for indirect, incidental, or consequential loss, including lost profits or lost opportunity.

8. Suspension

We may suspend or terminate access to tools if we reasonably believe you have breached these Terms of Use, or to protect the site, other users, or our providers.

9. Changes

We may update these Terms of Use from time to time. The "Last updated" date will change when we do. Continued use after an update means you accept the revised Terms of Use.

10. Governing law

These Terms of Use are governed by the laws of New Zealand. Courts of New Zealand have non-exclusive jurisdiction.
